Please read these Terms of Use ("Terms") carefully before using the Faida Business OS platform ("Service") operated by Faida Business OS ("we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Some parts of the Service are billed on a subscription basis ("Subscription"). You will be billed in advance on a recurring basis depending on the type of subscription plan you select.
All fees are exclusive of applicable taxes, which you are responsible for paying. Subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy.
You may cancel your Subscription at any time. Your cancellation will take effect at the end of the current billing period.
You agree not to use the Service:
You retain all rights to the business data you enter into the Service. We claim no ownership over your sales records, customer lists, inventory data, or any other business information you store on the platform.
You grant us a limited license to use, store, and process your data solely for the purpose of providing and improving the Service.
We strive to maintain 99.9% uptime, but we do not guarantee that the Service will be available at all times. We may experience hardware, software, or other issues that may result in service interruptions and data loss.
We reserve the right to suspend or terminate the Service for maintenance, updates, or emergency repairs with or without notice.
In no event shall Faida Business OS, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
These Terms shall be governed and construed in accordance with the laws of the Republic of Botswana, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
